Hal Scoggins has been with Farleigh Wada Witt since 1991 and practices in the firm’s Financial Services and Debtor/Creditor groups. He represents credit unions, banks, and other financial service providers on state and federal regulatory compliance matters, formation and operation of subsidiaries, contract negotiation and dispute resolution, bankruptcy and collection, and other issues related to structuring and delivering financial services to consumers and businesses.

Scoggins has a special expertise in payment systems issues, helping clients navigate Uniform Commercial Code Articles 3, 4, and 4A, the NACHA rules, and various Federal Reserve rules and circulars. He provides consumer and business loan and deposit account documentation and disclosures, and helps clients resolve account disputes and other operational challenges.

Kelley Hodney practices in the areas of financial services, succession planning, and corporate law. Before joining Farleigh Wada Witt, Hodney was an associate attorney in a mid-sized business law firm where she counseled individuals and business owners on estate planning and administration, business and farm succession planning, as well as some corporate and litigation matters. During law school she served as Chief Law Clerk in the Financial Fraud and Consumer Protection Section of the Oregon Department of Justice.

With a background in banking and business, Hodney brings considerable experience and working knowledge in the areas of consumer and commercial law relevant to assisting financial service providers on matters related to legal compliance. She monitors consumer regulatory changes and legislation in Oregon and Washington that affects financial service providers, and contributes updates for the firm’s Compliance Smart program.

Brian Witt has a specialized practice representing regional and national financial service providers on regulatory and compliance issues in Oregon and Washington.

Witt is a recognized national expert in the design and delivery of traditional and innovative financial products and services. Witt represents credit unions, financial service companies, and banks on regulatory and operational issues.

He works closely with national and state regulators on mergers, expansions and examination matters, and as chair of the firm’s Financial Services practice group, regularly tracks the impact of legislation and court decisions on financial service providers.
