What are “public funds?”

In Washington’s RCW 39.58.010(1), “public funds” refers to moneys under the control of a treasurer or custodian belonging to, or held for the benefit of, the state or any of its political subdivisions, public corporations, municipal corporations, agencies, courts, boards, commissions, or committees, including moneys held as trustee, agent, or bailee.

In Oregon’s ORS 295.001(16), “public funds” or “funds” means funds under the control or in the custody of a public official by virtue of office.

(17) “Public official” means each officer or employee of this state or any agency, political subdivision or public or municipal corporation thereof, or any housing authority, who by law is made the custodian of or has control of any public funds.
